Hukam Singh: I am Hukam Singh, a former member of the Indian Lok Sabha, the Lower House of Parliament. I was curious to see how our Constitution was serving our citizens. It has been more than 70 years since it came into effect and I thought it would be good time to assess its effects. Do intrigue me with your questions.

User: Were you involved in the making of the Constitution?
Hukam Singh: You could say that. I was a member of the Constituent Assembly of India from 1948 to 1950. In fact, I was a member when the Draft Constitution was debated in the Assembly.

User: So, you wrote the Constitution?
Hukam Singh: No, no! Nothing of the sort. I was just an ordinary member of the Constituent Assembly. I was not part of the Drafting Committee chaired by Dr. B. R. Ambedkar that actually drafted the text of the Constitution based on what had earlier been adopted by the Assembly and some of the committees.

User: So, what was your role in the Constituent Assembly?
Hukam Singh: Mine was that of any other ordinary member of the Assembly. We scrutinised the Draft Constitution that was circulated among the members. And if we wanted to comment on the draft or propose an amendment to the draft, we sought an opportunity from the President of the Assembly to do so in the time allocated for such debate.

User: So, did you actually speak in the Assembly about the Draft Constitution? Or propose an amendment?
Hukam Singh: I did both – actually. I spoke out against the restrictions that were imposed on the right to freedom in the Draft Constitution. I even offered a rebuttal to the points that Dr. Ambedkar had raised in support of the restrictions on our right to freedom. I went so far as to move an amendment to the Draft Constitution seeking the removal of all the restrictions on the right to freedom. Of course, my amendment was defeated.

User: How come?
Hukam Singh: Well, because I was a representative of the Shiromani Akali Dal in the Assembly. My party had hardly any members in the Assembly, much less a majority. And without a majority, there was no way an amendment could carry. And in that Assembly, the only party with a majority was the Indian National Congress. And, I suppose, they were not going to change the Draft Constitution that they had themselves come up with.

User: So, were all such amendments defeated?
Hukam Singh: Most were. Some would find favour with the Congress and they would make it into the Constitution. But, that was rare.

User: Why did you want to remove the restrictions on our rights in the Constitution?
Hukam Singh: Because my worry was that those restrictions would ensure that all laws of colonial provenance that criminalised expression, for instance, would survive any challenge to their constitutionality!

User: How so?
Hukam Singh: Well, think of any colonial law criminalising speech. Take sedition, for example. Now, if our Constitution guarantees our citizens the fundamental right to freedom of speech and expression, then it would follow that a crime like sedition would violate such a fundamental right, wouldn’t it?

User: Now that you are here in 2021, what do you feel about the Covid/coronavirus pandemic??
Hukam Singh: It is deeply disturbing and so distressing. I do not think that the Republic has faced an emergency of this scale since the Partition. I was rendered a refugee by the Partition myself, so I say this without any exaggeration. But, what is truly dispiriting about the deadly second wave of the pandemic is the response of the government. That the government was not adequately prepared for the most predictable phenomenon in a pandemic - a second wave - is mind-boggling to me. And that they still seem to be more occupied with deflecting criticism than addressing this emergency seems negligent to me.

User: How does the current pandemic compare with the one that you lived through in 1918-1919?
Hukam Singh: I was actually about to say that the current pandemic reminds me of the one that I lived through in 1918. I was a student at the Law College in Lahore then. I was not personally affected by the influenza epidemic, as it was called, but I do recall many others who were. The government back then was also caught unaware. Their lack of preparedness cost many lives. More than a hundred years on, despite independence, despite the Constitution, despite a government elected by the people of India, it seems like nothing has changed. And that makes me wonder about the work we did in the Constituent Assembly and Parliament on the Constitution. It seems to have made no difference, heralded no change. Maybe, I am just exaggerating.
